How to report abuse on H-2A: channels and rights
What to do if the employer doesn't pay correctly, charges fees or breaks the contract: how to gather evidence, where to report and how to protect yourself from retaliation.

Anyone who suffers abuse or receives incorrect pay on H-2A can report it to the Wage and Hour Division (WHD) of the Department of Labor, which investigates violations of the program. Keep evidence and don't hesitate to seek official help.
Quick answer: gather pay stubs, contract, messages and photos, note dates and names, and contact the WHD. The law prohibits retaliation against those who report. You can ask for help even if you are still in the job.
Situations worth reporting
- Pay below the amount in the job order or the required minimum.
- Unauthorized deductions or recruitment fees being charged.
- Inadequate housing or housing charged for when it should be free.
- No reimbursement of visa, travel or meals on the trip.
- Threats, passport retention or being prevented from leaving.
- Lack of pay stubs or of workers' compensation coverage.
