H-2A worker rights: contract, housing and transportation

H-2A workers have specific protections. Among them are the right to receive information about the job in writing, correct pay, adequate housing conditions when applicable and rules on transportation and expenses. The details depend on the contract and the rules in force, so keep your documents and consult official sources.

The Department of Labor states that the worker must receive a copy of the contract — or the equivalent job order — in a language they understand, with terms such as pay, duration, hours, benefits and working conditions.
Read it before traveling and keep a copy on your phone and in a safe place. Don't accept a verbal change that contradicts the document without asking for formal clarification.
Pay and pay stub
The employer must pay the rate applicable to the job and provide a statement with hours, earnings and deductions. The pay rules are detailed in Fact Sheet #26F.
Record your hours daily. If there is a difference, talk to the person in charge and keep copies of messages and receipts.
Three-fourths guarantee
In general terms, the H-2A contract includes a guarantee related to at least three quarters of the working days of the covered period. The calculation and the exceptions are technical; see Fact Sheet #26 for the full rule.
Housing
When the worker cannot return home the same day, the employer must provide housing at no cost that meets the applicable standards. Don't conclude that any accommodation shown in a photo is approved; the requirement must be met at the real site.
Transportation
The rules may involve daily transportation between housing and work, plus reimbursement of inbound expenses after a certain part of the contract and return transportation at the end, according to the official conditions.
Don't confuse transportation provided for by the rules with an informal promise of a free ticket in any situation. Read the contract and confirm the procedure.
Tools and equipment
The employer must provide, at no charge, the tools, supplies and equipment required to do the work, when the law determines that they must be provided.
Use the indicated safety equipment and report defects. Safety is not a favor; it is part of working conditions.
Recruitment fees
Employers and agents may not pass on to the worker fees tied to recruitment or certification. Be wary of charges to "release" a contract, reserve a position or guarantee approval.
