The problem of fraud in the sector
Unfortunately, the demand for jobs in the US attracts scammers who exploit the hopes of Brazilian workers. Knowing the most common scams is the best protection.
Most common scams
1. Advance fees
How it works: The "recruiter" asks for payment up front to "guarantee" the job, process documents or pay consular fees.
The truth: Legitimate H-2A employers never charge the worker to take part in the process. The costs are the employer's.
2. Jobs that don't exist
How it works: You pay, receive fake documents and only discover the scam when you reach the consulate or the airport.
How to check: Every legitimate H-2A job is registered in the DOL system. Ask for the case number and check it at flag.dol.gov.
3. Fake contracts
How it works: The contract presented does not match what was promised. Lower pay, worse conditions, a different location.
How to protect yourself: Read the whole contract before signing. If you don't understand English, ask for a translation. Keep a signed copy.
4. Unauthorized agencies
How it works: Agencies charge high commissions promising to make the process easier, but have no legal authorization to recruit for the H-2A program.
The truth: Recruitment must be done by agents authorized by the DOL. Ask for the agency's registration number.
